Terms & Conditions
These Terms & Conditions (T&C) are for DivoraRoma, LLC (DBA: Divora Destinations / DD). Please read the following T&C carefully as they apply to any reservation made through DD.
Reservation Conditions
Once your reservation has been made and paid for with the reservation fee, you will receive a confirmation email and receipt. DD’s tours all require a minimum of 4 guests to happen (unless otherwise stated or unless other arrangements have been made on a case by case basis - such as a DD Honeymoon Tour) and thus, may not be confirmed until 60 days before the tour is set to begin.
Reservation Fee & Final Payment
To confirm your tour, you will be required to make a $1,500 flat non-refundable reservation fee, applied towards the cost of your chosen tour. This constitutes the “reservation fee” which, when paid, constitutes the Client’s acceptance of these Terms & Conditions (I addition to the T&C in the tour contract itself - sent separately). The final balance payment is due 3 months prior to your chosen tour start date, unless otherwise stated. If you fail to pay by the due date(s), your reservation may be cancelled and your payments may not be refunded. DD will work with you to create a payment plan to aid in the payments due by 3 months prior to your intended departure date. If you make payments towards your trip, and then have to cancel within that process (including but not limited to you changing your mind and no longer wanting/being able to go), your reservation fee and any payment made towards the balance of the trip become a credit for you towards a new tour of your choosing within 2 years of the original start date. Besides the reservation fee, all payments made (if the tour is postponed or if you choose to cancel) will remain in escrow as a credit to your name so you may use the funds towards a new tour on another date within 2 years from the first day of your original tour. You will not lose your payments made, you will simply use them towards a future tour. Any future tour will may choose to apply your credit towards, may accrue fee increases as per economic changes imposed onto all of us (ie: a 2019 tour fee is not the same amount as a 2023 our fee).
Tour Postponement
A pandemic is beyond DD’s and your control. Due to Covid-19, many of our 2020 and 2021 tours have had to be postponed. We are working with our partners to be able to allow transfers. If your tour is postponed, we will transfer 100% of the payments you will have made, to another departure date of your choosing in 2022 and 2023. We will be adding new departure dates as we get more clarity on the situation so you may have plenty of options to choose from. If you are unsure you will be able to travel, you are welcome to transfer your payment(s) to someone else, or keep them in escrow with us as a credit for when you are ready to travel again, within 2 years from the start date of your original tour.
Tour Cancellation
If you cancel for any reason, after your $1,500 reservation fee payment and prior to your final payment, your $1,500 reservation fee and any other payment made, are non-refundable. Details: a cancellation made by you after the final payment, but with more than 60 days prior to the date of tour departure, will incur a cancellation fee of 75% of the full payment. A cancellation made by you with less than 60 days before the date of travel will incur a cancellation fee of 100% of the full payment.
DD reserves the right to cancel any tour and shall not be liable in the event of such cancellation. Cancellations of tours by DD have never happened, but if they must happen (we promise it would only be due to extreme circumstances dictated by DD - and NOT due to the current state of Covid-19 affrais), you will be notified with plenty of time to decide (1) whether to transfer your payments to a new tour date immediately, (2) to transfer your payments to a new traveler, or (3) to transfer your payments into escrow so you may have a credit with DD for future tours.
All DivoraDestinations tours are subject to a minimum number of 4 participants (unless otherwise stated or unless other arrangements have been made on a case by case basis - such as a DD Honeymoon Tour). Every endeavor is made to ensure the tours take place, but if the minimum number of travelers is not reached, the tour may be cancelled. No refund will be issued (i) in the event that a client fails to join his or her tour or does not utilize accommodation or any services; or (ii) for a partially completed tour other than as a result of the gross negligence or willful default of DD. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary.
DD also reserves the right to decline to accept or retain any person as a member of the tour at its own reasonable discretion. DD reserves the right to amend or vary the itinerary or other services nominated in the tour brochure, should it determine in its discretion that circumstances warrant such changes, that it would be in the best interest of the clients or for any other valid operational reason.
Should You be Asked to Leave a Tour
If you are asked to leave a tour for bad behavior, violence, or any other disruptive action, you will not be refunded.
Refunds
If you are eligible for a refund due to cancellation by DD, the balance (less fees and non-refundable payments), will be refunded to you. Please note that DD will not refund any payments until we have received refund monies from applicable suppliers. In some instances this can take up to 16 weeks OR it may never happen at all due to non-refundable policies imposed by the vendors themselves.
Payment Method
Credit card and Checks are acceptable forms of payment. There is a 3% fee imposed onto all credit card payments. There is no fee imposed onto check payments. Returned checks are charged a $50 fee. Late payments accrue $25 per day la charges.
DivoraDestinations Requires its Travelers to Purchase Adequate Travel Insurance
It protects you from cancellations, illness, any just about any other unfortunate and unpredictable issue that may arise (depending of the coverage you choose, of course). It is much more affordable than you may think and covers you above and beyond what you may think your AmericaExpress or other travel credit card says it covers you for. Passport & Visas
When traveling overseas, it is common sense that you must hold a valid passport with a minimum of six months validity from your return date. Foreign passport holders must have a re-entry visa. Traveling to other countries may require a visa or you may be refused entry. Please inform yourself prior to travel, or ask DD for information.
International Air Travel
Our tours are based on in-situ pricing. Booking international travel is the responsibility of the Client. Airline tickets are issued to and accepted by the traveler subject to the terms, regulations and conditions outlined at the time of booking by the airlines’ conditions of carriage. You are to find your own way to your starting location, based on the tour chosen. DD will offer advice on international travel, but the choice and the purchasing of it is the traveler’s responsibility.
Internal/Domestic Air/Maritime/Train/Road Travel
Internal air/boat/train/road travel is included where possible and where needed within our itineraries. Do check the inclusions for the specific tour you choose, to see what is included.
Accommodation
DD tours are sold as shared rooms, meaning, you will share your room with one other traveler by default. If you prefer to upgrade to your own private room, please contact us. Accommodation type varies based on tour. Some accommodations are luxury properties and/or holiday homes. Some are 3, 4 or 5-star hotels, depending on availability and resources of our suppliers in the country we will be visiting. If any of the lodgings noted in your itinerary are not available at the time of booking and a change becomes necessary, we will make every effort to ensure the substituted accommodation will be equivalent in standard. You may choose our no-lodging option in which case you are responsible for your own villa/apartment/hotel.
Sightseeing
Due to weather and factors beyond anyone’s control, sightseeing schedules may need to be altered. Don’t worry! We will have a blast no matter the weather. Our tours are rain or shine.
Prices
All prices are shown in US dollars. DD reserves the right to adjust tour prices prior to final payment in the event of any circumstance beyond its reasonable control (including but not limited to exchange rate movements between the quoted price and the actual price).
Inclusions
Ground transportation in the tour country, agreed number of nights’ accommodation if outlined, breakfast daily if outlined, most lunches and dinners, some entrance fees, some classes and tours according the individual tour itinerary. Please do consult the individual list of inclusions for each tour, as it is much more detailed.
Costs not Included
Our tours do not include airfare, passport or visa fees, taxes, travel and health insurance, telephone expenses, drinks unless specified, excess baggage charges, tips and services not otherwise listed and all items of a personal nature. Please do consult the individual list of exclusions for each tour, as it is much more detailed.
Change/Amendment of itinerary
DD reserves the right to change the itinerary for any reason, particularly if safety is a concern and certainly if vendor availabilities change. As this is a group trip, no individual itinerary changes shall be accepted during the tour. As a traveler with DD, you have ample time for privacy and to do as you wish, but during group scheduled itinerary items, you agree to be in the company of all of us. Please note we are not responsible for any incidental expenses that may be incurred by each traveler as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
Travelers Who Require Special Assistance
You must report any medical conditions or conditions requiring special assistance to us at the time of booking. DD and its suppliers will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so, nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. Country requirements for disabled access vary greatly, so DD cannot accommodate all disabilities, unfortunately. The key is communicating your condition with us at the time of booking.
Traveler Responsibilities
It is the responsibility of the client to obtain visas, passports, health certificates or other travel documents where required for the tour. It remains the client’s responsibility to ensure that these documents are in order and to meet any additional costs incurred as a result of failure to comply with such requirements. It is also the client’s responsibility to book his or her own airline tickets and to meet the tour at the scheduled time and place in the designated country where the tour begins. It is a condition of travel with DD that each traveler purchases and demonstrates proof of adequate travel insurance to provide protection against loss due to illness, injury, death, damage or loss.
Photos and Marketing
By traveling with DD you consent to the use of images taken to be used for advertising and promotional purposes unless otherwise notified. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes. The images are casual and responsibly taken, meant to show the fun experiences DD offers. You will have access to the images via online gallery so you may view them, and you may purchase digital downloads and/or prints of any image as mementos.
Limit of Liability
By accepting these terms, the client acknowledges and agrees that to the full extent permitted by law, DivoraRoma, LLC and its representatives shall assume no responsibility and will not be held liable for any personal injury, property damage, or other loss, accident, delay or inconvenience sustained by the client in the course of or as a result of services provided by DD as part of the itinerary, and that the client shall hereby release, discharge and/or indemnify DD and its representatives in respect of any such loss, injury or damage, accident, delay or inconvenience and/or from any liability arising from same.
Without prejudice to the foregoing, DD and its representatives shall have no liability or obligations to a client arising directly or indirectly out of any circumstance beyond its/their control including, but not limited to, breakdown in equipment, strikes, theft, delay, hijacking, act or threat of war (whether declared or not), riots, civil strife, terrorist activity, industrial disputes, discharge dispersal, release or escape of pollutants, natural and nuclear disasters, fire, sickness, bad weather, technical or transportation problems, closure of stations or airports, cancellations or changes of schedules by railways, air or bus lines, local epidemics or global pandemics, or any other circumstance amounting to force majeure and/or Act of God.
Disclaimer
DD is not a carrier or hotelier, nor does it own aircrafts, hotels or coaches. The services which DD provides consist of arranging and coordinating accommodation, tours and transfers, making bookings and issuing vouchers to be redeemed by suppliers if necessary. While DD exercises every care in the selection of reputable coach operators, hotels, vacation homes and other suppliers of the various services which are used in these tours, DD does not act as their agent and nor are such suppliers or service providers the agents of DD. It is important to note, therefore, all bookings with DD are subject to the terms, conditions and limitations of liability imposed by such suppliers or service providers whose services are utilized, some of which may seek to limit or exclude liability in respect of death, personal injury, delay and loss or damage of baggage.
The client acknowledges and agrees that DD and its representatives assume no responsibility to the client and will not be held liable by the client for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity by reason of (1) any wrongful or negligent acts or omissions on the part of the suppliers or service providers, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of any employee or representative of these suppliers or service providers, (3) any defect in or failure of any vehicle, equipment or instrumentality owned, operated, or used by any of these suppliers or service providers, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the direct control of DD.
